site founder and "business" owner brandon willey took $10,000 in payment, paid in full up front, for the service of designing an e-commerce website to specification for a single mother who took out a business loan to invest in a professional website to help her run her web-based business.

upon what the "designer" determined to be "project completion", the consumer clearly expressed that the product which she was being offered did not meet the requirements mr. willey agreed to fulfill, beforehand, when the terms of the verbal contract were negotiated and settled upon.

mr. wiley's response was to abandon the project, after which he proceeded to invest the sum that was paid to retain his services into his own start-up web design business, redPear (http://tasteredpear.com).

though accountability is understandably shared by the client for failing to obtain a service contract with explicit terms to their business arrangement, the willingness and ultimate act of accepting such a sum of money, with no offer of a refundable deposit if the product was found to be unsatisfactory, is surely cause for notice to be placed on the BBB record for this business.

as this manner of practice preys upon the ignorance of the consumer, who is not always educated to the necessity and security provided by service contracts, it would stand to reason that there is no incentive for this individual to discontinue such practices, so long as they go unchecked and under-regulated.
